Medical negligence medical malpractice clinical negligence Galway solicitors Dublin

Medical negligence cases against medical consultants and GPs arise typically due to a failure to refer a patient for further and proper medical investigations or due to misdiagnoses. For example, a consultant or GP might fail to appreciate the patient’s medical history and, as a result, prescribe inappropriate medication (or carry out a procedure which is contra-indicated). If significant injury to the patient arises from the above, the patient might be able to take a case for medical malpractice. Likewise, if a surgeon fails to use reasonable standards of care in carrying out a surgical procedure, a claim might arise.

If a mistake is made by a GP or a medical consultant, and this results in medical problems / complications, it might be possible to take a case. It is necessary to establish as that the medic/medical department has (in general terms) failed to reach the standard which is medically expected when carrying out the medical work.

To prove a case of medical negligence against a medical consultant or GP, a expert report is required to prove that the healthcare professional breached the duty of care owed to you. That expert must state that the doctor was negligent in the way they treated you, and that the stated injury has arisen as a direct consequence of that negligence. Often, patients don’t know what to do when this situation occurs to them. We at Callanan Murphy Solicitors have many years’ experience in the area of medical negligence claims in Ireland and have dedicated Solicitors who practice in the area.
