Where death is wrongly caused by poor medical treatment, a claim for a fatal injury might be possible. This claim is taken by the dependants of the deceased (usually the family / relations). If it can be proven that the death was caused as a direct consequence of a breach in duty of care by the healthcare professional treating the deceased prior to his / her death, a case can be brought. Compensation is apportioned to the dependants (called Solatium) as well as other types of damages such as loss of earnings into the home, loss of service etc.
To prove a case of fatal injury arising from medical negligence / medical malpractice, an expert report is required to prove that the healthcare professional breached the duty of care owed to the deceased.
